The United States Department of Education published a new regulatory amendment focusing on Title IX Sexual Harassment. The regulation sets forth specific definitions and requirements covering the Title IX grievance process. Enclosed are the new Title IX Sexual Harassment policies and procedures, and related training presentations.

“Title IX Sexual Harassment” means conduct on the basis of sex that satisfies one or more of the following:

  1. An employee of the District conditioning the provision of an aid, benefit, or service of the District on an individual’s participation in unwelcome sexual conduct (i.e., quid pro quo sexual harassment);
  2. Unwelcome conduct determined by a reasonable person to be so severe, pervasive, and objectively offensive that it effectively denies a person equal access to the District’s education program or activity;
  3. “Sexual assault” as defined in 20 U.S.C. 1092(f)(6)(A)(v), “dating violence” as defined in 34 U.S.C. 12291(a)(10), “domestic violence” as defined in 34 U.S.C. 12291(a)(8), or “stalking” as defined in 34 U.S.C. 12291(a)(30).

Employees who believe or have been made aware that they or any other employee, student, or visitor has been subject to Title IX Sexual Harassment shall report it to the Title IX Coordinator.

Elizabethtown Independent Schools does not discriminate on the basis of sex in its education programs or activities and is required by Title IX not to discriminate in such a manner. Questions regarding Title IX or reports of sex discrimination, including sexual harassment, may be referred to the District Title IX Coordinator, the Assistant Secretary for Civil Rights, or both.

Any person may report sex discrimination, including sexual harassment, to the Title IX Coordinator, regardless of whether the person reporting is the person alleged to be the victim of conduct that could constitute sex discrimination or sexual harassment. A report may be made in person, by mail, by telephone, by electronic mail, or by any other means that results in the Title IX Coordinator receiving the person's verbal or written report. A report may be made at any time, including during non-business hours, using the contact information listed above.

Upon receiving a report involving conduct that may constitute Title IX Sexual Harassment in an education program or activity, the Title IX Coordinator will contact the complainant to discuss the availability of supportive measures and explain the process for filing a formal complaint. Formal complaints of Title IX Sexual Harassment shall be addressed in accordance with Board policy, District procedures, and applicable law.

District Title IX policies, procedures, grievance procedures, reporting forms, and training materials are available on the District website or may be requested from the Title IX Coordinator.
